E-Poll Affiliates Terms and Conditions

This Agreement contains the complete terms and conditions that apply to an individual's or entity's participation in E-Poll Affiliate Referral Program (the "Program"). As used in this Agreement, "we" means E-Poll Inc., and "you" means the applicant. "Site" means a World Wide Web site and, depending on the context, refers either to E-Poll.com’s site, located at the www.epoll.com or to any site that you will link to our site (and which you will identify in your Program application).

Enrollment in the Program
To begin the enrollment process, you will submit a complete Program application via our site. We will evaluate your application in good faith and will notify you of your acceptance or rejection. We may reject your application if we determine (in our sole discretion) that your site is unsuitable for the Program. Unsuitable sites include those that:
- promote sexually explicit materials
- promote violence
- promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
- promote illegal activities
- include "E-Poll" or variations or misspellings thereof in their domain names
- otherwise violate intellectual property rights

If we reject your application, you are welcome to reapply to the Program at any time. You should also note that if we accept your application and your site is thereafter determined (in our sole discretion) to be unsuitable for the Program, we may terminate this Agreement.

Links on Your Site
Once you have been notified that your site has been accepted into the Program, you may provide on your site a general link to E-Poll.com home page at http://www.epoll.com.

We will provide you with guidelines and graphical artwork to use in linking to our home page. To permit accurate tracking and reporting, we will provide you with special "tracking" URL to be used in all links between your site and our site. You must ensure that each of the links between your site and our site properly utilizes such special link formats. ie: banners, text links, your web site, in emails, or any other form of correspondence with your members or friends. They must visit that tracking URL and register and take a survey at that time for you to get credit for their membership. We can not be responsible for keeping track of points if this procedure is not followed by your referred customer.

You acknowledge that, by participating in the Program and placing any of the above links within your site, EPoll.com may receive information from or about visitors to your site or communications between your site and those visitors. Your participation in the E-Poll.com program constitutes your specific and unconditional consent to and authorization for E-Poll.com's access to, receipt, storage, use, and disclosure of any and all such information, consistent with the policies and procedures set forth in E-Poll.com's http://www.epoll.com/privacy/privacy.asp

Email Rules
Anyone submitting our Referral ID URL to friends and members through an email list must follow these email guidelines:


	The email list you use MUST be OPT-IN. (In other words, they have given you expressed permission to send them email.)

	The email must come from you through your own ISP. Your name and email address must be in the "FROM" section of the email. Identify yourself in the email and give your correct return email address should the recipient want to unsubscribe from further emails or ask any questions.

	The E-Poll Rewards program offer can only be sent once to each recipient.

	Absolutely NO "spamming" allowed.

Referral Fees

We will pay you referral fees on each valid, confirmed, and non-duplicated participant who signs up in the E-Poll Rewards program and takes at least one emailed survey. We will pay your referral fees when your balance due is $50.00 or greater. You can access your account through the E-Poll Affiliate Program http://affiliates.epoll.com/

Tracking System

E-Poll tracks referrals by using a cookie/pixel system on the DirectTrack™ network system – the system uses cookies to track users referring from your site/email/newsletter. The lead is logged when a visitor from your site clicks on the creative you select. You will be credited appropriately upon the completion of requirements by your referral.

Indemnification

Each affiliate/member agrees to defend, indemnify and hold harmless E-Poll, its affiliates and their respective directors, officers, employees and agents from and against all claims, demands, causes of action and expenses, including attorney's fees, arising out of the use of this program by such affiliate/member.

Termination

E-Poll reserves the right to reject any web site that contains content that we deem not appropriate for affiliation such as, but not limited to, sexually oriented material, gambling, propaganda, or illegal activities. The term of this Agreement will begin upon our acceptance of your Affiliate Network application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination provided that EPoll.com may provide written notice to you via e-mail. E-Poll requires a minimum level of referrals to remain active in the E-Poll Affiliates Program. Any affiliate that fails to refer 10 leads in any 6 month period will be automatically terminated. Any outstanding referral fees due to you will be paid out as stipulated in section 4 of these Terms & Conditions.

Trademarks.

Affilate agrees that the trademarks, trade names, service marks, copyrights and other proprietary rights of Bridge Entertainment/E-Poll shall remain the sole and exclusive property of the company and Affiliate shall not hold itself out as having any ownership rights with respect thereto or, except as specifically granted hereunder, any other rights therein.
